13. GOVERNING LAW; ARBITRATION; CLASS ACTION AND JURY TRIAL WAIVER
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Before initiating arbitration, you and Kampo Care agree to make a good-faith effort to resolve any dispute informally.
Except for claims eligible for small claims court or where prohibited by applicable law, disputes arising from or relating to these Terms, the Site, Platform Services, or products purchased through the Site will be resolved by binding individual arbitration administered by JAMS in accordance with its applicable consumer arbitration rules and minimum standards.
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND KAMPO CARE WAIVE THE RIGHT TO A JURY TRIAL AND AGREE TO RESOLVE DISPUTES ON AN INDIVIDUAL BASIS, RATHER THAN AS A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.
Nothing in this Section prevents either party from seeking injunctive or other relief from a court where such relief is permitted by applicable law.
14. TEXT (SMS) MESSAGE TERMS
